ProteoMetrics LLC expressly disclaims, and the
Licensee hereby expressly waives, all warranties express or implied, including warranties of
fitness for a particular purpose. ProteoMetrics LLC does not warrant that
KNEXUS will meet the Licensee's requirements or that the operation of KNEXUS for
Intranet will be uninterrupted or error-free, or that defects in KNEXUS will be capable
of being corrected. ProteoMetrics, LLC 's limited warranty is in lieu of all liabilities or
obligations of ProteoMetrics LLC for damages arising out of or in connection with the delivery,
use or performance of KNEXUS.
The Licensee shall defend, indemnify and hold ProteoMetrics LLC and its officers, directors,
agents, and employees harmless from and against all liability, costs, demands, damages, expenses
(including attorney's and expert witness fees and expenses) and losses by reason of death,
personal injury, illness or property damage, or any other injury or damage arising from the use of
KNEXUS by the Licensee.
